Conditions of Sale:
Payment and delivery:
Full payment is due prior to the release and shipping on all orders. As a payment method we accept MasterCard, Visa, American Express, PayPal, CashiersChecks, Certified Checks and Bank wire transfers. In the case of some business and personal checks- payment must clear before orders are shipped. A return authorization, “RA”, is required before merchandise is accepted back for a refund. Returns are resold as “demo” or “open box” merchandise and as a result are subject to a 15% restocking fee. Shipping and tax is the sole responsibility of the buyer. Shipping charges are non refundable. All other sales are final.
Terms of Purchase:
The buyer and seller mutually agree upon the terms of payment unless the seller specifies in writing a different payment method. Company checks may be accepted based on the buyer providing the company’s banking and credit references. Larger company and foreign orders/purchases will typically require a bank wire transfer or Cashiers’s check. Any additional terms or exceptions will be made at the judgement of the seller-Master Sound Pro Audio.
Any exception to the normal payment before shipping will be billed at a net 10 day payment. If full payment is not received within a 30 day period the buyer agrees that this unpaid balance will commence to bear interest at the rate of 2.5% per month from the 10th day after delivery. All further legal costs of collecting the unpaid balance will be incurred and paid for by the purchasing customer.
If a check is received that is returned due to insufficient funds or stopped payment, the seller will demand a cash, credit card or wire transfer payment in full with a possible suspension of all future check payments at the sellers discretion. A charge of $45 will be made to all buyer’s returned checks. To most efficiently conduct selling business and provide our customers with efficient and prompt service, buyer’s are to conduct business in seller’s terms and agreement. Any change or exception must be mutually agreed upon and must be set forth in a prior agreed contact signed by both buyer and seller.
“RA”- Return Policy:
Some items are not returnable such as computer software as required by copyright legislation restrictions. Items which are special order items and items that are not normally stocked or are ordered from a manufacturer for a specific customer are non refundable/returnable. However if an item is defective or not working properly we will work with the customer and manufacturer to insure that the item receives full warranty repair or replacement according to the manufacturers stated warranty.
All items returned without a Master Sound Pro Audio return authorization #, (RA#), will be returned to the buyer. All shipping costs for return authorization items are the sole responsibility of the buyer. All returned merchandise is subject to a 15% restocking fee.
All defective merchandise must be returned within 72 hours, (3 days), of delivery date and must be in its original packing, boxes, cartons, and original new item condition, unmarred, with the original instruction manuals, manufacturers paperwork and blank warranty cards. Failure to return an item in this condition will result additional restocking fee penalties. A credit will be issued as a payment or merchandise credit upon receipt of merchandise in prior mentioned condition.
Taxes:
Master Sound Pro Audio’s advertised prices do not include sales, excise, user, customs, duty or similar or varying taxes associated with the sale of merchandise and goods sold by Master Sound Pro Audio . Taxes and shipping fees are the sole responsibility of the buyer. Customers who are tax exempt must provide a tax exempt certificate acceptable to taxing authorities before receiving tax exemption from their purchases.
Use and Installation of merchandise:
The installation, operation and use of all purchased equipment from Master Sound Pro Audio is the sole responsibility of the buyer. This includes manufacturers authorizations and software installation, licenses and conditional use license acquisitions.
Buyer Agreement and Conditions:
Seller shall not be bound or held to buyer agreements, purchase order conditions or contracts unless seller agrees to such conditions in writing in a signed contract prior to sales of merchandise. Such conditions must be mutually agreed upon in a written contract. All sales conditions will conform to this seller’s page of terms unless contractually altered and mutually agreed upon. If a contract is not mutually agreed upon in writing and signed by both the selling and buying party then the conditions and terms set forth in these terms and agreements shall serve as the terms and conditions for both the buying and selling parties.
Disputes:
All disputes under any contract or sales order from Master Sound Pro Audio with a buyer will be resolved in a legal court of jurisdiction for the seller’s place of business in Virginia Beach, Virginia and in no other place or jurisdiction. Buyer agrees to appear for a court action and agrees to the action and determination of the court. No action or legal dispute may be brought by buyer for any action associated with the goods sold and provided by Master Sound Pro Audio later than 1 year from the original sales date. All settlements will be in accordance with the state laws of Virginia.
State Laws:
All agreements, sales and performances, (actions), shall be governed and in accordance with the state laws governing business practices in the state of Virginia.
